The need for mediation becomes a necessary part of many divorce proceedings when custody or visitation privileges of their minor children by one or both parents becomes an issue before the Family Court. Family Law Private Mediator Panel 2004 As with many court matters, outside assistance may be required for the judge to make a fair decision regarding parental rights consistent with the best interests of the child. While the Family Court generally relies on the mediators of Family Court Services (FCS) for assessments and recommendations, any approved mediator agreed upon by both parties can provide those services. Qualified mediators who are trained in law and/or counseling and human behavior will have one or more of the following designations to indicate their level of training and experience.
